Can i inspect the property whenever i like?

You can, however, the tenant needs to be given 7 days notice. The Owner/Agent are limited to a maximum of 4 inspections in any 12 months period.

Can you pay monthly bills for me and when will I receive my cheque?

We can pay any bills associated with your property. This includes utilities, taxes, insurance, maintenance, loan payments and any other property-related payment you may have to make. Should any money remain with us after payments, we will send this balance to you, or remit it to your bank account, generally on the same day or in two business days after the rent has been received.

How will you update me about my tenants and rented/leased property?

Frequent visits: We will visit your property periodically and report back to you through member login page / email.

 

Regular telephonic/online contact: We will keep in regular touch to ensure your requirements are being addressed satisfactorily. If you need to contact us, we are available during normal business hours. If you cannot reach the person you want, leave a message. He/she will call you back within the same business day, or at the beginning of the next business day.

 

Email: Our staff will attend to all your email requirements immediately, whether they are at office or on the field.

 

Online account: On signing our property management service agreement, we will assign you a personal secured online membership account on our website. Through this online account, you will have access to all your important documents, including your property management agreement, tenant’s lease, maintenance work details and much more! You will also receive emails through this account and be able to keep track on all transactions and messages, from anywhere and at any time.

How much will it cost to market my rental property?

The security deposit amount depends on the location of the property. Generally, it is equivalent upto 3 months’ rent.

Is there any renewal of rental agreement if I continue to stay after my lease period is over?

Yes. A detailed rental agreement with all the points mutually agreed will be documented and signed between both the parties along with witnesses signatures.

How do I pay rent?

Rent is either collected by us personally or you can visit our office and deliver your rent  to us in person.

When is my rent due?

The due date may vary from owner to owner, but is usually between the 1st and 5th of the month. It is noted in the rental agreement.

How long will it take to complete the maintenance work?

We try to see that work is attended to at the earliest, so the tenant is not inconvenienced.   In general, we ensure work is completed within 10 working days. However, schedules are dependent on the kind and amount of work required.

Can I terminate my lease early? If so, what is the procedure?

If you wish to terminate your lease before its expiration, we require 60 days advance notice. Following your intimation, procedures will be followed as per the rental agreement. An inspection will be conducted before you move out and the security deposit will be handed over as mentioned in the lease agreement.

What are the hidden costs in buying a property?

Stamp duty and registration, service tax and value added tax (VAT) will have to be payed for the property. Apart from these, there are also Preferential Location Charges, Utility Charges, Advanced maintenance charges and advanced amenities charges.

How much will it cost to sell my property?

There are three main costs involved in selling a property:

  • Estate Agent Fees

    Estate Agent Fees will either be a percentage of the purchase price, or a fixed fee. When estate agents visit to value your home, make sure they outline their fees so you can take these into account.

  • Energy Performance Certificate (EPC)

    You are legally required to provide an EPC when you market your property for sale. This outlines the energy efficiency rating of your property. Your Move can organise this for you. Contact your local branch for a quote for how much this will cost. In Scotland you will need a Home Report which includes an EPC.

  • Conveyancing

    ‘Conveyancing’ means the legal transfer of your property to the buyer, and you will need to employ a solicitor to make this happen. Prices will vary depending on your circumstances. Your Move can introduce you to a solicitor and offer a no sale no fee conveyancing service with a guaranteed fixed price to keep everything easy. Contact your local branch to receive an accurate quote for how much this will cost.

You may also decide to pay for extras such as professional photography or advanced web positioning. And don’t forget about removals. Ask your agent to outline all these costs at the start of your sale so that you can budget your move.

What is construction monitoring?

Construction monitoring service enables you to construct your house without needing to be physically present to monitor the progress. Our experienced team will monitor the entire construction process & keep updating you with periodic progress reports on developments. Any problems / issues identified shall be escalated to you for action. This service includes taking digital pictures of the construction in progress and sending it to you.

Who will conduct construction monitoring & how frequently you would monitor my property?

Our experienced team will handle this activity and the frequency of our visit to your property can be determined by you. We would suggest weekly / fortnight / monthly visits to the property.  PROPERTYHANDLING's service fee will vary based on the frequency of the inspection / visit & and the distance from our branch office. The monitoring service only involves checking progress against milestones. It is understood that under the normal construction monitoring service, PROPERTYHANDLING is not required to provide the services of a qualified site engineer to check for quality. Requests for a Site Engineer to manage the project shall be treated separately.

What will your report contain & how does that help me in ensuring the quality of the work?

PROPERTYHANDLING will compare the progress on the construction with the schedule listed in the agreement entered into with the contractor / architect and will let keep you updated. These updates shall include: Digital images of the progress at construction site Progress charting against milestones listed in the agreement Issues related to construction / vendor (if any) Any problems identified shall be escalated to you for action.

What is the recourse if the construction is not completed as per my expectations?

PROPERTYHANDLING's scope of services is only to monitor the progress of the construction against milestones and report back to you. PROPERTYHANDLING shall not be responsible for deficiencies in the quality of work delivered by the contractor / architect or default due to non-payment by client or any other deficiencies due to force majeure causes.  In case of any deficiencies, it is expressly understood that the owner / customer may take recourse to legal remedies against the defaulting party for breach of contract. In such a situation, you have the option to use PROPERTYHANDLING's legal services or any other legal support separately available to the client.

How would PROPERTYHANDLING assist me in getting a documents issued from respective government authorities?

We will check with the concerned Government department on the supporting documents requirements like copy of the sale deed, copy of encumbrance certificate, etc. Requirements will be communicated to you along with the tentative expenses that would be incurred to obtain the certificates.  We will initiate the work once we receive the required supporting documents and the estimated amount for obtaining these certificate.

What is encumbrance certificate & why / when is it required?

Encumbrance certificate (EC) records transfer of ownership of a property in succession up to the current owner. It shows the date, names of the parties involved and amount of consideration, extent and schedule of the property. It is required at the time of selling the property as it provides details about the title/ownership of the property

What if the required repairs & renovation work is not completed as per my expectations?

PROPERTYHANDLING's responsibilities, in the event of deficient work by vendor shall be to take steps to rectify such deficiencies at vendors cost within a reasonable time period. PROPERTYHANDLING's decision on what constitutes deficient work shall be final.

Can I modify my request on the repairs / renovation items after PROPERTYHANDLING starts the work?

Yes, you can modify your request provided such modification is feasible at that stage of work. If feasible, we will check with the vendor on the requested changes and will intimate you on the cost implications of the same. Modifications will be initiated only after the receipt of funds based on the revised estimate.

How do you check and verify if the property you are selling on my behalf really belongs to me?

Ownership of the property will be assessed by our empanelled legal experts after going through the property papers provided to us either by you or your representative. Once the rental cheque is collected and deposited to your account your Relationship Executive shall intimate you via email and shall request for a confirmation of credit to your bank account. We have an experienced team of people who know how to tackle rent defaulters in a legal manner. In most situations, when the tenant realizes that we mean business they will be willing to go for a negotiated settlement and vacate peacefully. If not, we will leave it to our empaneled legal counsel to obtain the court order directing the tenant to leave and local law enforcement agencies will be pressed into service if the tenant does not co-operate. Does your service cater to any time repairs for the tenant? Do you undertake repairs / renovation work on behalf of the landlord if requested for?

No, our tenant package does not include any time repair services for the tenant. Minor repairs and fixes are part of the tenant's responsibility as per most lease agreements in India. In the event this has to be handled as well, it shall be taken up separately through an empanelled vendor of PROPERTYHANDLING at extra costs. Major repairs and renovation that shall affect the building structure unless specifically caused by negligence / misuse by the tenant, usually come under the landlord's responsibility. If a major repair / renovation request is given by a tenant or if assessed independently by us, the same shall be intimated to you. If you choose to use our services for repairs / renovation or even for just supervising the work you can request for an estimate. We will liaise with our vendors / estimate the effort and give you a quote. Once you accept the quote and upon receipt of payment we will proceed with the requested work after informing the tenant. Updates and monitoring reports as may be agreed upon shall be given from time to time till completion of work. An assessment on work completion will be done by qualified personnel from our company In case of an unforeseen emergency where there is danger to human life or property we may initiate repair works without waiting for an approval and the owner shall be contacted as soon as possible. Such repair work carried out by our vendors shall be inspected and certified by qualified personnel from our company. Once the work is completed the bill for the emergency repairs shall be sent across and will have to be reimbursed by the owner within a time frame of 15 days. If I were to get you to paint the house through your vendor and after a few months if the paint were to start peeling off or start showing bubbles what can I do about it?

Defects that get noticed after a few months could be due to various reasons. Poor workmanship could be one, but it could also be due to inherent defects in the structure, water leakage during rains or any such cause. Can the branch / liaison office of a foreign company purchase immovable property in India?

A foreign company which has established a Branch Office or other place of business in India, in accordance with the Foreign Exchange Management (Establishment in India of Branch or Office or other Place of Business) Regulations, 2000, can acquire any immovable property in India, which is necessary for or incidental to carrying on such activity. The payment for acquiring such a property should be made by way of foreign inward remittance through the proper banking channels. A declaration in form IPI should be filed with the Reserve Bank within ninety days from the date of acquiring the property. Such a property can also be mortgaged with an Authorized Dealer as a security for the purpose of borrowings. On winding up of the business, the sale proceeds of such property can be repatriated only with the prior approval of the Reserve Bank. Further, acquisition of immovable property by entities incorporated in Pakistan, Bangladesh, Sri Lanka, Afghanistan, China, Iran, Nepal and Bhutan and who have set up Branch Offices in India and would require prior approval of the Reserve Bank.

However, if the foreign company has established a Liaison Office in India, it cannot acquire immovable property. In such cases, Liaison Offices can acquire property by way of lease not exceeding 5 years.

Can NRI / PIO avail of loan from an authorised dealer for acquiring flat / house in India for his own residential use against the security of funds held in his NRE Fixed Deposit account / FCNR (B) account? How the loan can be repaid?

Ans. Yes, such loans are permitted subject to the terms and conditions laid down in Schedules 1 and 2 to the Notification No. FEMA 5/2000-RB dated May 3, 2000 viz. Foreign Exchange Management (Deposit) Regulations, 2000, as amended from time to time. Banks cannot grant fresh loans or renew existing loans in excess of Rs. 100 lakhs against NRE and FCNR (B) deposits, either to the depositors or to third parties. The banks should also not undertake artificial slicing of the loan amount to circumvent the ceiling of Rs. 100 lakh. Such loans can be repaid in the following manner: (a) by way of inward remittance through normal banking channel or (b) by debit to the NRE / FCNR (B) / NRO account of the NRI/ PIO or (c) out of rental income from such property (d) by the borrower's close relatives, as defined in section 6 of the Companies Act, 1956, through their account in India by crediting the borrower's loan account.

(iv) The lender shall credit the loan amount to the borrower’s NRO account in India or shall ensure credit to such account by specific indication on the payment instrument; (v) The loan agreement shall specify that the repayment of loan shall be by way of remittance from outside India or by debit to NRE/NRO/FCNR Account of the borrower and the lender shall not accept repayment by any other means.

Can NRI / PIO repatriate outside India the sale proceeds of immovable property held in India?

(a) In the event of sale of immovable property other than agricultural land / farm house / plantation property in India by a NRI / PIO, the Authorised Dealer may allow repatriation of the sale proceeds outside India, provided the following conditions are satisfied, namely: (i) the immovable property was acquired by the seller in accordance with the provisions of the foreign exchange law in force at the time of acquisition by him or the provisions of these Regulations; (ii) the amount to be repatriated does not exceed: · the amount paid for acquisition of the immovable property in foreign exchange received through normal banking channels, or · the amount paid out of funds held in Foreign Currency Non-Resident Account, or · the foreign currency equivalent (as on the date of payment) of the amount paid where such payment was made from the funds held in Non-Resident External account for acquisition of the property; and (iii) in the case of residential property, the repatriation of sale proceeds is restricted to not more than two such properties. For this purpose, repatriation outside India means the buying or drawing of foreign exchange from an authorised dealer in India and remitting it outside India through normal banking channels or crediting it to an account denominated in foreign currency or to an account in Indian currency maintained with an authorised dealer from which it can be converted in foreign currency. (b) in case the property is acquired out of Rupee resources and/or the loan is repaid by close relatives in India (as defined in Section 6 of the Companies Act, 1956), the amount can be credited to the NRO account of the NRI/PIO. The amount of capital gains, if any, arising out of sale of the property can also be credited to the NRO account. NRI/PIO are also allowed by the Authorised Dealers to repatriate an amount up to USD 1 million per financial year out of the balance in the NRO account / sale proceeds of assets by way of purchase / the assets in India acquired by him by way of inheritance / legacy. This is subject to production of documentary evidence in support of acquisition, inheritance or legacy of assets by the remitter, and a tax clearance / no objection certificate from the Income Tax Authority for the remittance. Remittances exceeding US $ 1,000,000 (US Dollar One million only) in any financial year requires prior permission of the Reserve Bank. (c) A person referred to in sub-section (5) of Section 6 of the Foreign Exchange Management Act 3[3][3], or his successor shall not, except with the prior permission of the Reserve Bank, repatriate outside India the sale proceeds of any immovable property referred to in that sub-section.

If the immovable property was received as inheritance by the NRI/PIO can he repatriate the sale proceeds?

Yes, general permission is available to the NRIs/PIO to repatriate the sale proceeds of the immovable property inherited from a person resident in India subject to the following conditions: (i) The amount should not exceed USD one million, per financial year (ii) This is subject to production of documentary evidence in support of acquisition / inheritance of assets and an undertaking by the remitter and certificate by a Chartered Accountant in the formats prescribed by the Central Board of Direct Taxes vide their Circular No.4/2009 dated June 29, 2009 (iii) In cases of deed of settlement made by either of his parents or a close relative (as defined in section 6 of the Companies Act, 1956) and the settlement taking effect on the death of the settler (iv) the original deed of settlement and a tax clearance / No Objection Certificate from the Income-Tax Authority should be produced for the remittance (v) Where the remittance as above is made in more than one installment, the remittance of all such installments shall be made through the same Authorised Dealer (vi) In case of a foreign national, sale proceeds can be repatriated if the property is inherited from a person resident outside India with the prior approval of the Reserve Bank. The foreign national has to approach the Reserve Bank with documentary evidence in support of inheritance of the immovable property and the undertaking and the C.A. Certificate mentioned above. The general permission for repatriation of sale proceeds of immovable property is not available to a citizen of Pakistan, Bangladesh, Sri Lanka, China, Afghanistan and Iran and he has to seek specific approval of the Reserve Bank. As FEMA, 1999 specifically permits transactions only in Indian Rupees with citizens of Nepal and Bhutan. Therefore, the question of repatriation of the sale proceeds in foreign exchange to Nepal and Bhutan would not arise.

Yes, a person who had bought the residential / commercial property / agricultural land/ plantation property / farm house in India when he was a resident, continue to hold the immovable property without the approval of the Reserve Bank even after becoming an NRI/PIO. The sale proceeds may be credited to NRO account of the NRI /PIO.

A person resident in India who is a citizen of Pakistan or Bangladesh or Sri Lanka or Afghanistan or China or Iran or Nepal or Bhutan is governed by the provisions of Foreign Exchange Management (Acquisition and Transfer of Immovable Property in India) Regulations, 2000, as amended from time to time, i.e. she/he would require prior approval of the Reserve Bank for acquisition and transfer of immovable property in India even though she/he is resident in India. Such requests are considered by the Reserve Bank in consultation with the Government in India.

Mutation is a process by which transfer / change of name takes place in the records of the Municipality office for the concerned property Mutation basically means rectification in the records of the municipal authorities replacing the name of the old owners of a property with that of the new owner. Mutation of property in the municipal/ revenue records is mainly for the purpose of payment of property taxes in the name of the new owner. Further, if the new owner intends to sell the property, it would be difficult for him to do so if the property does not stand mutated in his name.

How will you handle tenant eviction if a tenant goes bad and refuses to vacate?

If a tenant refuses to move out after being served a due termination notice as per the lease agreement terms, we will seek your approval and file an eviction lawsuit on behalf of you. In most situations, when the tenant realizes that we mean business they will be willing to go for a negotiated settlement and vacate peacefully. If not, we will leave it to our legal counsel to obtain the court order directing the tenant to leave and local law enforcement agencies pressed iwill be nto service if the tenant does not co-operate. Legal costs of tenant eviction are separate and it shall be estimated by the empanelled lawyers depending on complexity, location and the lease terms.
